1. About Candide
Candide ("the App") is a flashcard and spaced-repetition study tool operated by the Candide team ("we", "us", "our"). By downloading or using the App, you agree to be bound by these Terms and Conditions. If you do not agree with any part of these Terms, please do not use the App.
2. Eligibility
You must be at least 13 years old to use Candide. If you are under 18, you confirm that you have obtained the consent of a parent or legal guardian. By using the App, you represent and warrant that you meet these age requirements.
3. Account Registration
You must create an account to access most features of Candide. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to provide accurate, current, and complete information and to notify us immediately at contact@getcandide.com if you suspect any unauthorised use of your account.
4. Subscription & Billing
Candide offers a free tier and an optional Pro subscription, billed monthly or annually. Subscriptions are processed through the Apple App Store or Google Play Store. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period. You can manage and cancel your subscription in your device's account settings at any time. Prices may vary by region and are displayed in the App prior to purchase. Refunds are subject to the policies of the relevant app store.
5. AI-Generated Content
Candide uses artificial intelligence to generate flashcards from content you provide. AI-generated content may contain errors, inaccuracies, or omissions. You are solely responsible for reviewing and verifying any AI-generated flashcards before relying on them for academic or other purposes. We make no warranties regarding the accuracy, completeness, or fitness for purpose of any generated content, including for use in examinations.
6. Your Content
You retain full ownership of all content you upload to the App. By uploading content, you grant us a limited, non-exclusive, royalty-free licence to process that content solely to provide the App's services to you. You represent that you have the legal right to upload such content and that it does not infringe any third-party intellectual property or other rights.
7. Intellectual Property
All intellectual property rights in the App — including its design, code, brand, and any content we provide — are owned by us or our licensors. Nothing in these Terms grants you any right to copy, modify, distribute, sell, or create derivative works based on any part of the App, except as expressly permitted by us in writing.
8. Acceptable Use
You agree not to: (a) use the App for any unlawful or fraudulent purpose; (b) upload content that is illegal, harmful, threatening, or infringes third-party rights; (c) attempt to gain unauthorised access to the App or its underlying systems; (d) reverse-engineer, decompile, or disassemble any part of the App; or (e) interfere with or disrupt the integrity or performance of the App.
9. Privacy & Data
Your use of Candide is subject to our Privacy Policy, which is incorporated into these Terms by reference. We collect and process personal data in accordance with applicable law, including the EU General Data Protection Regulation (GDPR) where applicable. If you are located in the European Economic Area, you have the right to access, rectify, erase, and port your personal data. 10. Disclaimer of Warranties
The App is provided on an "as is" and "as available" basis. To the fullest extent permitted by applicable law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or free of harmful components.
11. Limitation of Liability
To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of or inability to use the App, including any loss of data or academic results. Our aggregate liability to you for any claims arising under these Terms shall not exceed the greater of the total amounts you paid us in the 12 months preceding the claim or €10.
12. Changes to Terms
We may update these Terms from time to time. Material changes will be notified through the App or by email. Your continued use of the App after any update constitutes your acceptance of the revised Terms. The most current version of these Terms is always available within the App under Profile → Terms & Conditions.
13. Governing Law & Contact
These Terms are governed by Swiss law, without regard to its conflict-of-law principles. Any disputes will be subject to the exclusive jurisdiction of the courts of Switzerland. For any questions about these Terms or the App, please contact us at contact@getcandide.com.
